Landlord and Property Manager Responsibilities in NSW
Under current NSW rental rules, landlords must ensure smoke alarms are installed where required and kept in working order. Landlords must also carry out an annual check of smoke alarms, replace removable batteries annually except where a removable lithium battery is used in accordance with the manufacturer’s instructions, and arrange repair or replacement of hardwired alarms through an authorised electrician. If a smoke alarm is not working, repair or replacement must generally occur within 2 business days of the issue being identified.
Landlords, agents and tenants must not remove or interfere with the operation of a smoke alarm unless there is a reasonable excuse. Landlords and agents can access a rental property for smoke alarm inspection with at least 2 business days’ notice, and for smoke alarm repair or replacement with at least 1 hour’s notice.
Smoke Alarm Installation Requirements in NSW
In NSW, owners must ensure smoke alarms are installed on or near the ceiling in the correct locations. For most homes, that includes each storey containing a bedroom, in each corridor or hallway associated with a bedroom, or if there is no corridor or hallway, between the bedroom area and the rest of the dwelling. A smoke alarm is also required in a storey that does not contain a bedroom. Smoke alarms installed under these requirements must be functioning and comply with AS 3786.
Holiday Accommodation and Short-Term Rental Compliance
Owners of short-term rental and holiday accommodation in NSW must also comply with fire safety requirements, including smoke alarm obligations under the STRA Fire Safety Standard. This makes regular testing, maintenance and correct alarm placement especially important for accommodation providers.
